Welcome to SkyStream Technologies! These Terms of Service ("Terms") govern your use of SkyStream products, including our streaming media players and associated services. By purchasing, using, or accessing any SkyStream product or service, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using any SkyStream product or service, you signify your agreement to these Terms. If you do not agree to these Terms, you may not use our products or services.
2. User Eligibility
Our products and services are available to users of all ages. By using SkyStream products, you confirm that you are capable of forming a binding contract with SkyStream Technologies and are not barred from receiving services under the laws of the United States or other applicable jurisdiction.
3. SkyStream Products and Services
SkyStream Technologies provides innovative streaming media players designed to enhance your home entertainment experience. Our devices operate on the official Android TV OS and provide access to a wide range of authorized streaming applications available through the Google Play Store. We are committed to delivering high-quality, Google-certified hardware.
4. Prohibited Uses
You agree not to use SkyStream products or services for any purpose that is unlawful or prohibited by these Terms. Specifically, you agree not to:
•Reverse Engineer: Attempt to reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying components of our hardware or software.
•Commercial Applications: Use SkyStream devices or services for any commercial purposes, including but not limited to public broadcasting, commercial displays, or any use that generates revenue without explicit written consent from SkyStream Technologies.
•Circumvent Copyright: Use SkyStream products or services to circumvent copyright protection, download, stream, or otherwise access copyrighted material without proper authorization from the copyright holder. SkyStream Technologies is not responsible for any user actions that violate copyright laws.
•Illegal Activities: Engage in any activity that is illegal, fraudulent, or harmful to SkyStream Technologies, its users, or third parties.
5. Intellectual Property Rights
All content, trademarks, service marks, trade names, logos, and intellectual property displayed on or through SkyStream products and services, including the SkyStream brand, device designs, and proprietary software/firmware, are the exclusive property of SkyStream Technologies or its licensors. You agree not to use, reproduce, distribute, or create derivative works from any such intellectual property without explicit written permission from SkyStream Technologies.
6. Third-Party Content and Services
SkyStream devices provide access to third-party applications, websites, and content (collectively, "Third-Party Services"). These Third-Party Services are not owned or controlled by SkyStream Technologies. We do not endorse, and are not responsible for, the content, availability, accuracy, privacy practices, or any other aspect of such Third-Party Services. Your use of Third-Party Services is solely at your own risk and subject to their respective terms and conditions.
7. Limitation of Liability
To the maximum extent permitted by applicable law, SkyStream Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the products or services; (b) any conduct or content of any third party on the products or services; (c) any content obtained from the products or services; and (d) unauthorized access, use, or alteration of your transmissions or content. This limitation of liability applies to all claims, whether based on warranty, contract, tort, or any other legal theory, whether or not SkyStream Technologies has been informed of the possibility of such damage.
Specifically, SkyStream Technologies is not responsible for:
•Any user actions that violate copyright laws or intellectual property rights by accessing, downloading, or streaming unauthorized content.
•The content, availability, or performance of any Third-Party Services accessed through SkyStream devices.
•Any damages or losses arising from service interruptions, data loss, or issues related to third-party content.
8. Account Security
If you create an account with SkyStream Technologies or use any service that requires account credentials, you are solely responsible for maintaining the confidentiality of your account information, including your password. You agree not to share your password or account details with any third party. You are responsible for all activities that occur under your account. SkyStream Technologies cannot and will not be liable for any loss or damage arising from your failure to comply with this security obligation.
9. Governing Law and Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Florida for the purpose of litigating all such claims or disputes.
10. Changes to Terms
SkyStream Technologies reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our products or services after those revisions become effective, you agree to be bound by the revised terms.
